In accordance with the Decree of the President of the Republic of Uzbekistan dated July 6, 2021 "On additional measures for the effective organization of anti-corruption activities" from October 1, 2021, it is planned to set up the activities of internal anti-corruption control units in all state bodies and organizations, including the Council of Ministers of the Republic Karakalpakstan, khokimiyats of regions and the city of Tashkent.
The Anti-Corruption Agency of the Republic of Uzbekistan is in charge of this duty (hereinafter - the Agency).
Internal control units are responsible for taking measures for early detection and prevention of corruption facts, elimination of their causes and conditions, prevention of conflicts of interest and formation of an intolerant attitude towards corruption.
Accordingly, the order of the Director of the Agency "On Approval of the Model Regulations on the Activities of Internal Anti-Corruption Control Units" was registered on September 8, 2021.
The order states that the divisions of internal anti-corruption control are directly subordinate in their duties to the first head of the organization (supervisory board).
This, in turn, ensures that internal anti-corruption control units operate independently of other structural units.
The heads of the internal anti-corruption control are hired through an open competition. This will make it possible to staff these structures with the most appropriate personnel.
The heads of these units cannot be fired from office without the approval of the Anti-Corruption Agency, and the independence of the structures must be ensured.
The main duties of the Control Structures are:
- improving the anti-corruption activities of the organization;
- prevention and fight against corruption in the organization;
- ensuring and monitoring the effective functioning of the anti-corruption system in the organization;
- cooperate with other state bodies and organizations involved in and participating in anti-corruption activities.
According to the regulation, in order to carry out these tasks, number of rights and obligations have been assigned to the anti-corruption control unit.
Particularly, employees of the Control Unit can conduct inspections, request documents and receive written explanations from employees. In case of revealing signs of crime in the organization's system, specially, cases of corruption, immediately informs the higher authority, the Agency and other law enforcement agencies.
The Agency is responsible for assessing the effectiveness and objectives of the control structure, as well as their verification, according to the Regulation.
The adoption of this Regulation contributes to the implementation and development of an integrated system that meets the requirements of the international standard ISO37001: 2016 to combat corruption in government agencies and organizations. This, in turn, serves to ensure early detection of cases of corruption, their causes and conditions, prevention of corrupt practices, unconditional implementation of anti-corruption documents.
