Based on the tasks stipulated by the Decree of the President of the Republic of Uzbekistan No. DP-6013 of June 29, 2020, the Anti-Corruption Agency has studied and analyzed the practice of courts applying certain types of punishment in the form of imprisonment to persons who committed corruption crimes.
For reference: Deprivation of a certain right is a measure of criminal legal influence, which consists in prohibiting a person convicted of a crime from holding office for a certain period of time.
The deprivation of a certain right is one of the most effective means of preventing the commission of such crimes by a given person (as well as other persons).
According to the analysis, in 2019, the courts initiated 3,576 cases of corruption against 5,565 persons, in 2020 - 2,834 cases against 4,159 persons, and in the first nine months of 2021, 3,722 criminal cases were initiated against 6,197 persons.
2,574 (or 54 percent) of 4,741 convicted persons in 2019, 1,740 (or 51 percent) of 3,394 convicted persons in 2020, and 2,131 (or 47 percent) of 4,572 convicted persons in 2021 were sentenced to deprivation of a certain right.
That is, the practice of assigning certain punishments to persons convicted of corruption offenses is declining from year to year.
The analysis showed that one of the reasons for the increase in the number of corruption crimes is the reduction in the practice of assigning certain types of punishment.
In this regard, the Anti-Corruption Agency is developing proposals for improving legislation in this area.
