The Anti-Corruption Agency has analyzed the public procurements made by government customers in March 2022 on a special public procurement information portal.
It was revealed that in March of this year, 71,490 public procurements were made in the amount of 2,972.2 billion soums, including 33,834 procurements through an online store in the amount of 2,462.2 billion soums, 33,319 direct procurements in the amount of 251.3 billion soums, 3,162 selecting the best offers in the amount of 44.9 billion soums, 1,175 procurements through auctions in the amount of 213.8 billion soums.
During remote monitoring conducted by the Agency in April 2022, a number of violations of the requirements of the public procurement legislation were identified.
In particular, in four cases, budget customers for procurement in the amount of 2.6 billion soums, and in four cases corporate customers for public procurement in the amount of 159.1 billion soums, violated the requirements of the Law on Public Procurement, to which 8 statutory notices were submitted.
Based on these statutory notices, procurements were canceled by three customers, as a result of which illegal public procurements in the amount of 2.1 billion soums were prevented. Currently, 5 statutory notices are under consideration by customers.
For example, the public procurement of the Joint Stock Commercial Bank Uzpromstroybank (The Uzbek Industrial and Construction Bank) was studied for the ‘subscription to foreign newspapers and magazines for 2022’ through the special information portal etender.uzex.uz in the amount of 149 million soums.
The study showed that the customer violated the requirements of the Law ‘On Public Procurement’ and the Regulation ‘On the organization and conduct of procurement procedures’, registered by the Ministry of Justice No. 3016.
According to it, on April 20, 2022, a statutory notice was submitted to the Joint Stock Commercial Bank Uzpromstroybank, due to which the public procurement was canceled.
The public procurement for the supply of hot meals in the amount of 1.37 billion soums through outsourcing services to the order of the Urgut District Medical Association was also studied.
The study detected a conflict of interest in violation of articles 10, 14, 19 and 42 of the Law ‘On Public Procurement’ and the Law ‘On Competition’, that is the winning company was owned by a member of the commission.
Based on the identified violations, on April 19, 2022, the Anti-Corruption Agency submitted a statutory notice to the Urgut District Medical Association, and the public procurement was canceled.
Also, the documents collected regarding the occurrence of a conflict of interest with a member of the commission were sent for consideration to the Prosecutor General’s Office.
In addition, at the request of the Agency, in one case, the prosecution authorities initiated a case on administrative liability against the perpetrators.
