The Anti-Corruption Agency together with the Supreme Judicial Council organized August 2 a round table on the theme ‘Prevention of Corruption in the Judiciary.’
According to the meeting participants, the Decree of the President of the Republic of Uzbekistan of December 7, 2020 ‘On measures to ensure the true independence of judges and increase the effectiveness of preventing corruption in the judiciary’ brought reforms in the judiciary to a higher level. The Decree identified the main tracks of state policy to ensure the independence of judges and prevent corruption in the judiciary.
For to early identify and eliminate the risks associated with the occurrence of corruption cases in the field, the Supreme Judicial Council established the Judicial Inspectorate for Ensuring Immunity of Judges and Preventing Corruption.
According to the analysis, most of the complaints (120) received by the Anti-Corruption Agency in the first half of 2022 were regarding complaints against court decisions (55 complaints against court decisions in criminal cases, 38 complaints against court decisions in civil cases, 18 complaints against decisions of the Economic Court, 9 complaints against decisions of the Administrative Court).
The round table also discussed the issues of identifying factors causing corruption offenses in the system, prevention, conducting various studies, organizing trainings on ethics and integrity for judges, strengthening public control, as well as improving existing legislation.
In this regard, areas of cooperation between the Supreme Judicial Council and the Anti-Corruption Agency were discussed.
In particular, the joint development of legal documents aimed at eliminating corruption factors, the coordination of actions of the two parties in order to improve the country’s position in the international rankings of the Rule of Law Index and the Corruption Perceptions Index, as well as the exchange of views on the conduct of anti-corruption expertise of existing legal documents and their projects aimed at regulating the industry.
In addition, it was emphasized that it is necessary to systematically analyze cases of corruption in the judicial system, develop joint measures to eliminate identified shortcomings and problems.
A Memorandum of Cooperation was signed between the Anti-Corruption Agency and the Supreme Judicial Council in order to effectively implement important goals and objectives considered within the framework of the round table.
The Memorandum has a number of important goals, including the joint development of draft legal documents aimed at ensuring the true independence of judges and improving the legal mechanism for preventing and combating corruption in the field, as well as compliance with the rules of ethics among the employees of the judiciary, the formation of an intolerant attitude to corruption and the culture of combating it, improving the skills of personnel working in the field of combating corruption.
