The Anti-Corruption Agency regularly conduct studies of public procurement announcements posted by government customers through special information portals.
In total, in November 2022, 100,410 public procurements were made in the amount of 6,288.6 billion soums, of which 57,887 procurements in the amount of 410.52 billion soums through an electronic store, 3,447 procurements in the amount of 64.40 billion soums through an electronic auction, 5 515 procurements in the amount of 1,105.5 billion soums by selecting the best offer, 189 tender procurements in the amount of 855.2 billion soums, 6,588 single source procurements in the amount of 1,310.7 billion soums, 26,784 direct procurements in the amount of 2,542, 3 billion soums.
The studies revealed the violation of the law by some government customers in the public procurements.
In particular, in November 2022, the Anti-Corruption Agency submitted seven statutory notices to relevant agencies and organizations to cancel the procurement results and take appropriate measures to prevent this type of violations in the future.
To date, public procurements for four out of seven statutory notices have been cancelled.
The materials collected on ten identified cases of violation of the law in the amount of 45.0 billion soums were sent to law enforcement agencies.
In particular, when studying the documents and information related to public procurement by the Kumkurgan District Medical Association to select the best offer for the overhaul of the building of the family clinic No. 32 in the amount of 588.3 million soums, it was revealed that business entities, participated and won in the bidding, owned by affiliates.
Also, within the framework of public procurement for the provision of transport services during construction and installation works in the amount of 130.0 million soums by order of the Yangikurgon District Road Maintenance Unitary Enterprise, business entities belonging to affiliated persons won the bidding.
However, in both cases, the procurement commissions did not remove affiliated persons from the bidding lists and thereby violated the requirements of Article 42 of the Law ‘On Public Procurement’ and Article 14 of the Law ‘On Competition’. Accordingly, statutory notices were made to relevant organizations and higher-level organizations to cancel the results of procurement and undertake appropriate measures to prevent this type of violations in the future.
According to the response letters of the Ministry of Health of the Republic of Uzbekistan dated November 24, 2022 and the Yangikurgon District Road Maintenance Unitary Enterprise dated November 23, 2022, the procurement results were canceled.
The materials collected on the above cases were sent to the Prosecutor General’s Office for a legal assessment.
