On February 7, 2023, the Anti-Corruption Agency conducted monitoring of public procurements on a special information portal, which revealed a number of violations of the legislation on public procurement during the public procurement by the Preschool Education Department of Olot District, Bukhara Region, to select the best proposal for the purchase of equipment in the amount of 33.1 million soums.
In particular, products of only one manufacturer were requested to participate in the selection process, which created non-competitive environment and conditions for the emergence of corruption.
According to Article 34 of the Law of the Republic of Uzbekistan ‘On Public Procurement’, the description of public procurement of goods (works, services) should not include requirements or references regarding a specific trademark or name, patent, design or model, specific source of origin or manufacturer.
Based on the above circumstances, the customer was submitted a statutory notice to eliminate this offense and cancel the contest.
Also, the Anti-Corruption Agency submitted the collected materials on the case to the Ministry of Economy and Finance for the adoption of appropriate legal measures. By the decision of the Olot District Court for Criminal Cases of March 2, 2023, officials who violated the law were brought to administrative responsibility under Article 1758 of the Code of Administrative Responsibility.
